GA GOP Rep. Would Force Women To Prove Miscarriage Happened Naturally Or Face Felony Charges
Edited on Wed Feb-23-11 04:12 PM by tpsbmam
You have to be fucking kidding me!!

Georgia state Rep. Bobby Franklin (R) has made a name for himself by introducing far-right extremist bills. He has introduced legislation barring the state from requiring vaccinations, eliminating income taxes and replacing them with nothing, and requiring state taxpayers to only pay in gold or silver.

Now, he has introduced what may be his most offensive and extreme bill yet. Last week he unveiled HB 1, which would, as the parenting blog Babble explains, “require proof that a miscarriage occured naturally.” If proof could not be provided, the mother could face “felony charges”:

State Rep. Bobby Franklin of Georgia introduced a bill in his state last week that, if enacted, would require proof that a miscarriage occurred naturally. If a woman can’t prove that her miscarriage–or spontaneous abortion–occurred without intervention, she could face felony charges.

According to WebMed, the overall miscarriage rate in the United States is 15-20 percent. The Mayo Clinic estimates that the “the actual number is probably much higher because many miscarriages occur so early in pregnancy that a woman doesn’t even know she’s pregnant. Most miscarriages occur because the fetus isn’t developing normally.” If Franklin’s radical legislation were to be enacted, it could mean that as many as a fifth of pregnant Georgian women would be forced to have their miscarriages reviewed by the government — the bill suggests creating a county registration list for fetal deaths — which would be a dangerous and unprecedented intrusion into their private lives. (HT: ThinkProgress reader Libel)

I'm speechless beyond you have to be fucking kidding me!!

2. Two questions on this: Why, and how?
Does he want women suffering from a miscarriage stay home and bleed to death for fear of prosecution? That would be the end result of trying to force proof of something which the victim has no way of providing.

This is a whole new degree of bat-shit crazy.

3. Many bills are introduced. Few become law.
This one will not become law.

4. I'm just amazed that anyone is even sick enough to suggest this law. I think
it's important to keep exposing these nutcase right wingers for what they are. Doesn't matter if it becomes law (well it does, but it's highly unlikely to go far at all) -- someone is actually trying to make it law. Someone that people voted into office! THIS is the kind of crap you're getting with these tea party voters. IDK if he's a tea party politician or not, but the sicko right-wingers who hid the worst of their biliousness are feeling freer and freer to show themselves for who they are. I want to keep seeing how deeply depraved they are.

9. Nothing wrong with exposing these things, but they never
get passed. There are wacko nutcases in every state legislature, and stupid bills are far more numerous than bills with a chance to pass.

The best approach is to just call them idiots when they introduce this crap and wait until the thing dies in committee, assuming it ever reaches that level. Most nutcase bills do not.

I've seen this posted already on DU at least one one time. It's not worth the energy of getting angry about. Just another nutcase bill.

5. Maybe he could call it the "Protection of Marriage, Family and Motherhood Act"
http://revcom.us/i/086/monstrous-en.pdf

Under the Nazi Regime in Germany all miscarriages were to be registered and investigated. German women were encouraged to produce lots of “good German” children for “good German” families—while homosexuals were rounded up as threats to this goal. Excluding those groups in society deemed “inferior” and marked for extermination, abortions were illegal. Under the law for the “Protection of Marriage, Family and Motherhood,” violations could be punished with death.

I think Georgia state Rep. Bobby Franklin (R) should have to prove that he personally didn't commit all those miscarriages or face felony prosecution.

11. I posted about this days ago and got very little response. I've seen several other OPs about it too.
Again, with little response.

If I want to be diplomatic, I can say that it's probably because we're all fired up and distracted by the labor uprisings. If I want to be cynical, I can observe that this, like most other issues that are perceived as "women's issues", is not considered a major party priority.

15. well... Rick Perry is just as "Pro-life"... in Tx
"Perry on Senate passage of sonogram legislation
Published: Sunday, February 20, 2011 12:56 AM CST
AUSTIN – Gov. Rick Perry issued the following statement on the Senate passage of SB 16, related to requiring a woman to have a sonogram before an abortion procedure:

“I commend the Texas Senate for quickly passing SB 16, an important achievement in our efforts to protect life. Considering the magnitude of the decision to have an abortion, it is crucial that Texans understand what is truly at stake. We know that when someone has all the information, the decision to choose life becomes clear. I look forward to working with House members to pass this legislation quickly, to ensure Texans are fully informed when considering such an important decision.”

I pointed out to my fellow readers that there were 9000 REPORTED rapes in Texas last year, which did not count statuatory rape, incest and non-consensual sex.I asked them if Perry was willing to be as supportive of these mothers after the baby was born.

Needless to say,I was called a baby killer.

18. GA Rep. Seeks to Criminalize Unauthorized Vaginal Bleeding
Franklin's bill is radical even by the standards of people who think fertilized ova are people. It's unusual because proponents of ovum personhood swear up and down that they're not trying to do an end run around Roe v. Wade. They will swear up and down that they're just trying to protect pregnant women from violent boyfriends and drunk drivers, or to punish drug addicted moms, or to save snowflake babies, or whatever. Of course we all know what their next move would be if they succeeded, but they know better than to put the egg-person stuff and the criminalization of abortion (or "fetal murder" as Franklin calls it) in the same bill.

Franklin's bill gives the game away by declaring that the while Supreme Court has absolutely no idea when personhood begins, the Georgia legislature knows perfectly well: "The General Assembly knows the answer to that difficult question, and that answer is life begins at the moment of conception." The bill does not explain how the General Assembly purportedly knows this.
