I wonder if the GOP would have thought could get away with this if Dems had reinvigorated unions with federal protection, and unions were growing instead of slowly dying.

If Dems had taken that kind of bold action, there probably would not be as many GOP governors and GOP dominated legislatures in the first place, so they wouldn't have the power to do this.

The Democratic Party leadership thinks they have outsmarted the American people because the GOP is headed toward a demographic demise and the Dems can then take over the corporate water boy mantle, but they have been so eagerly seeking that and so actively shitting on the people who put them in office that could easily join or even beat the GOP to the garbage heap of history.

They could have prevented this. They could still take action to stop it, but I suspect they are too busy talking to their hedge fund manager, banker, and corporate CEO bosses to bother.

1. I think the Scott Brown election threw a major wrench into the
EFCA. I talked with a high level union rep from D.C. early in the health care debate. He mentioned that EFCA was a priority, but they (his union anyway) felt HCR was top priority. I honestly think the tea party backlash combined with the Scott Brown election caught many in top level positions off guard and they had to totally rewrite the playbook. It totally sucks that the rewrite was dems acting like they were intimidated and scared. I wish they would have framed the issues from the beginning, been bold and brave, and set out a progressive vision for the Country. Alas... we are where we are.

2. Absolutely nothing would have happened.
EFCA amends the National Labor Relations Act which only applies to private sector workers. EFCA would not apply to public sector workers union or not.

4. Maybe. It is hard to say.
Almost all states are facing budget problems and voters have indicated they will not tolerate tax hikes. That is the root of the problem.
