PHOENIX - State senators voted to make race- and gender-based abortions illegal, but not before adding provisions that could send doctors and others involved in these acts to prison.

Monday's 21-5 vote came amid charges and countercharges about whether girls and blacks are being targeted in the womb. Lawmakers from each side cited figures designed to back their contentions.

The only clear thing is that the bill, which already has been approved in similar fashion by the House, is likely headed to the governor's desk, possibly by the end of the month. And Gov. Jan Brewer has signed every measure restricting abortion that has been sent to her.

HB 2443 does more than make criminals out of doctors who terminate a pregnancy knowing the woman's reason is to select the race or gender of the child. It also imposes criminal penalties on anyone who solicits or accepts funds to finance abortions based on race or sex.

Violators would face a presumptive prison term of 3.5 years.

2. Couldn't a woman then just lie to get around the law?
So say a white woman wants to abort because the baby's father is black. But that's now illegal, so she just lies and says that she can't afford to raise a child.

Regardless of one's position on abortion, this seems like a poorly written law.

3. Is there a test that can be conducted in the uterus to determine race of the fetus?
I thought one selects the race of a fetus by the choice of the father.

5. Huh... strange.
Sure we can agree that getting a race or gender-based abortion is reprehensible, but this just falls straight into 'unenforceable' territory. Burden of proof being on the state, the only real way to get the Doctors that do it is with sting ops... and that would smack of entrapment.

File this under 'stupid shit'.

7. What a waste of time...
Do women really abort just because she doesn't like the sex of the child? I really don't think many abort because of the race anymore either...(I guess in bigot country they do though?)

8. I really doubt women abort based on gender or race.
It's just like these a-holes saying a woman will carry to term and then decide at the last minute to get an abortion. It's an attack on women and I'm getting tired of it.

Imagine being a young heterosexual man reaching sexual maturity in a generation that has an engineered shortage of young women.

The only options for some men in those countries are to move away, or import a wife from somewhere else.

12. This bill is an attempt to undermine Planned Parenthood
For those not clear what's going on they claim, with supposed videos to back them, that Planned Parenthood officials are taking money from people interested in limiting the number of births African American women have. They're also quoting bogus figures on how many AA women are having abortions.

This is their newest angle to get into our wombs. They're claiming racism/sexism. I've seen the billboards regarding the racism angle in Texas as well.


That latter provision is aimed at Planned Parenthood. Proponents of the measure, citing undercover videos, say organization representatives have taken money from individuals interested in limiting births to African American women.

Sen. Don Shooter, R-Yuma, cited figures from the Frederick Douglass Foundation which said that 30 percent of all abortions in Arizona are to black women. The latest census figures show people who identify themselves as black at 4.1 percent of the population.

But the Arizona Department of Health Services reports that in 1999, the most recent year available, 7.3 percent of all abortions were to black women.

Shooter said he was got the press release from Rep. Steve Montenegro, R-Litchfield Park, the sponsor of the legislation. Montenegro, in turn, said he was relying on the foundation, which describes itself as Christian and pro-life; the foundation's founder, Timothy Johnson, said he got the Arizona statistics from a researcher on his staff.

But Montenegro said any discrepancy in the data is irrelevant.

16. Has anyone EVER met anyone who aborted a baby because it was the "wrong" sex?
Even with all the technology available, most people I know don't even want to know the sex of the baby . ( although many eventually relented before the birth :)..)

It amazes me how some legislators spend so damned much time making laws for a narrow slice of life, while ignoring the really important BIG issues that affect MOST people..

18. In this country, let alone the state of Arizona, especially.
As I said above (post #12) this is really about undermining Planned Parenthood and finding a new angle to to control a woman's womb.

I admit I've not seen the sexist angle being used yet, but I have seen the racist angle on local billboards.
