Many Omaha workers and their employers will soon begin having some interesting new conversations: What kind of car do you drive? Do you carpool to work or take a bus? Can you provide a copy of your automobile registration receipt? And is it OK to take $50 or more out of your paycheck to pay Omaha's commuter wheel fee?

The additional questions and new paperwork for businesses are required by the controversial wheel fee, which takes effect Saturday — if the law passes legal muster. A committee of Omaha-area suburban leaders and residents will hold a press conference Wednesday to announce plans to sue the city in district court, federal court or both. The group, spearheaded by Bellevue City Council President Carol Blood, contends that the fee is unlawful.

If the fee is upheld in court, it still might be more than a month before businesses need to start collecting information. Their first reports — and fee payments — will be due April 15. Omaha's new fee was created last summer. Omaha City Councilman Chris Jerram proposed it as a way to raise street maintenance revenue from Omaha workers who live outside the city. Mayor Jim Suttle signed it into law. The new fee matches the wheel tax paid by city residents and those who live within the city's three-mile zoning jurisdiction in Douglas County. With the new fee, city officials are requiring Omaha employers to help identify workers subject to the fee and to collect the payments.
