Appeals court rules that Trump's third travel ban is illegal ...Violates Federal Law

The U.S. Court of Appeals for the Ninth Circuit ruled Friday evening that the third version of President Donald Trump’s proposed ban on immigrants from primarily Muslim nations was a violation of federal law and exceeded his authority. In a three-to-zero ruling, the presiding judges declared that Trump’s efforts to bar nationals of six majority-Muslim countries from entering the U.S. “once again exceeds the scope of his delegated authority” under federal law. The court stayed its ruling pending review of its decision by the U.S. Supreme Court.

A federal appeals court ruled that the latest version of President Donald Trump's controversial travel ban policy should be partially

blocked because the president appears to have exceeded his authority in issuing the directive.

However, the unanimous decision issued Friday by a three-judge panel of the 9th Circuit Court of Appeals will have no immediate effect because of a temporary ruling the Supreme Court issued earlier this month allowing the administration to fully implement the ban as it appealed a pair of injunctions issued against the policy.


The policy Trump issued in September limits issuance of visas to citizens of six majority-Muslim countries.

9th Circuit Judges Michael Daly Hawkins, Ronald Gould and Richard Paez issued a 71-page joint opinion saying the president's order arrogates power that Congress reserved through legislation it passed.

The last Muslim Ban ruling by the SC was 7-2. Kagan and Breyer sided with the administration. Expect most of these cases to come out the same way.
