Manafort is suing DoJ, challenging appointment of Mueller.

Kevin Downing, a Miller & Chevalier partner advising Manafort in the U.S. Department of Justice’s investigation into alleged links between the Trump campaign and Russia, left the firm Thursday.

“We conducted a conflicts check and analysis,” the firm said Friday through an outside spokeswoman. “We subsequently determined that an existing client matter prevents the firm from representing Mr. Manafort at this time.”

Downing “decided to leave the firm so that he can represent Mr. Manafort,” the firm said. source

§ 600.4 Jurisdiction.

(a)Original jurisdiction. The jurisdiction of a Special Counsel shall be established by the Attorney General. The Special Counsel will be provided with a specific factual statement of the matter to be investigated. The jurisdiction of a Special Counsel shall also include the authority to investigate and prosecute federal crimes committed in the course of, and with intent to interfere with, the Special Counsel's investigation, such as perjury, obstruction of justice, destruction of evidence, and intimidation of witnesses; and to conduct appeals arising out of the matter being investigated and/or prosecuted.

(b)Additional jurisdiction. If in the course of his or her investigation the Special Counsel concludes that additional jurisdiction beyond that specified in his or her original jurisdiction is necessary in order to fully investigate and resolve the matters assigned, or to investigate new matters that come to light in the course of his or her investigation, he or she shall consult with the Attorney General, who will determine whether to include the additional matters within the Special Counsel's jurisdiction or assign them elsewhere.

(c)Civil and administrative jurisdiction. If in the course of his or her investigation the Special Counsel determines that administrative remedies, civil sanctions or other governmental action outside the criminal justice system might be appropriate, he or she shall consult with the Attorney General with respect to the appropriate component to take any necessary action. A Special Counsel shall not have civil or administrative authority unless specifically granted such jurisdiction by the Attorney General.

It's only more money for his lawyers, seeing what sticks.

Might as well give it a shot before you go away to prison Manny.

Not by Mueller. What is the relevance? It won’t even delay his case. I would assume a deputy AG has his case.

Fuck him, revoke his plea deal and screw him to the wall.

Mueller had to act within a time limit or statute of limitations would have barred prosecution. Manafort knows this charge cannot be brought again if he can get rid of it, no matter how guilty and how much evidence there is. He almost got off scott free on that but #TrumpRussia intervened. Manafort should have stayed in the background like Roger Stone, working in secret.

They are being sued as representatives of the government. Their names are on the suit, but the intent is to compell the government to do something. This is common practice when suing the government.

And judicial sanctions.

It’s got some sound bites for Faux News, but it’s mostly nonsense. The brief actually manages to argue against itself, which is... weird. Not in a “state weaknesses in my own argument and preemptively argue against them” sort of way, but in an actual, self-defeating sort of way.

Everything you need to know about why this is a bullshit motion is actually in the motion, unrefuted.

In a usual court proceeding, Manafort would have to explain in substantial detail how Mueller was exceeding his authority. That is, what specific matters was Mueller looking into that are beyond his jurisdiction. The non-specific nature of Manafort's appeal to authority (blanket citation of the Declaratory Judgment Act and the "long-recognized authority of the federal courts" ) indicates a weak legal argument.

That being said, all it will take is one sympathetic judge who welcomes our incipient fascist regime to buy this pile of hogwash and issue a ruling against Mueller.
