Can Undocumented Immigrants Make Legal Claims the Same as You and I?
Assuming you and I are native born or naturalized American citizens, can undocumented immigrants make the same claims as we could in a court of law? Most experts say they can.

If that's the case, how can the government charge a non-citizen with a crime that they are alleged to have committed as a minor? Children can not be held responsible for a crime that their age prevents them from understanding.
And, all undocumented persons, regardless of age, should be able to invoke the statute of limitations provisions. If a person can establish that they entered the country without the proper documentation more than 5 or 7 years ago, depending on the statute cited, can that person claim that immunity, provided they've committed no other crime during that time?
I really don't know the answer to these questions and perhaps a DUer with greater understanding of the law can explain this to me.
