it's always a bit of negotiating between the prosecutor and the defense attorney, but the defense doesn't have much leverage while the prosecutor can always get a subpoena.

except when the target is the president, in which case a subpoena can lead to a lengthy involvement with the courts as they weigh national security and presidential precedents.

donnie being a very uncooperative person in general, i would expect mueller to have to go the subpoena route.

or, as some have suggested, just not bother and proceed without it. it's not likely to produce useful information anyway other than to add a perjury charge. note that i don't think that means it's a "perjury trap". if donnie told the truth it might yield useful information, it's just that i expect him to prefer to lie.

I mean if Mueller is 100% sure he will succeed, then Mueller can call the shots 100% probably right?

whether or not mueller has the goods, donnie and his lawyers can drag it all out, and a subpoena might only serve to delay matters, which mueller might not want.

arguably, if mueller knows he has the good, then a subpoena is less likely to be useful as it makes it more likely donnie will simply "not remember" or otherwise evade answering.


in truth, a subpoena/interview for donnie actually has less to do with the case against donnie than with cases against others around him. it's actually an opportunity for donnie to try to shift blame if he wants to risk "remembering" something.
