Any semi-competent prosecutor has enough evidence RIGHT NOW, just from what we know from what's out there in the public domain, to convict him of Obstruction. He acts very bizarre, as a guilty person but it is not a proof. In courts, only proofs matters.

And even a wrong move can be attenuated or discarded for many reasons. It depends on the context.
