Why Trump could never become a Dictator..

If a US President were to declare martial law, would he have the power to dissolve Congress and stay in office for more than two terms?



Nothing in the Insurrection or Posse Comitatus Acts – which are the two laws a President may invoke to declare a state of martial law – contain provisions for the dissolving of Congress and putting an end to term limits.

The laws' combined purpose is to give the Federal government authority to suppress insurrections and restore civilian rule where it’s been compromised, not further subvert it. Furthermore, the President is not authorized to invoke either of those Acts without the consent of the State(s) into which troops are to be deployed (Insurrection Act) or Congress for their use in a domestic law enforcement capacity (Posse Comitatus Act).

In both those cases, it is very clear in the law that the emergencies for which the military may be deployed in a domestic capacity are limited to insurrections and the breakdown of civilian authority within a State. Once civilian institutions are back up and running, and their ability to enforce State and Lastly, while a lot of the other answers have pretty much made those same points, I’ll offer one more that’s been overlooked: The military obeying any order to dissolve Congress and maintain the President in power beyond his lawful term.

They wouldn’t.

In the military, an order is lawful unless it violates the Constitution or other laws of the United States. A President legally imposing martial law would be a valid order, but if he intended the overthrow of Congress and installation as President-for-life, then the orders would be seditious by their nature (ie, a conspiracy for the effective overthrow of the government), and thus unlawful.
