So sad how bitter we gotta be about shit like this. Death is everyones ending, it's one thing we should kind of hope to respect. Just for closures sake.

My guess would be given he has not been convicted that a request like this would be granted.

Depends on their judge, lawyer, charges, and conditions they find themselves under.

It's like bail. Some poor people don't get bail, some do. What's the difference? Judge, lawyer, charges, and the conditions they find themselves under.
