Federal Judge Upholds Massachusetts’s Assault-Weapons Ban

Here is the part about basing the ruling on Scalia's decision. Note, this is what the RWers are arguing, that the SCOTUS already ruled on this and the federal judge's decision will be overturned.

Young, nominated by former President Ronald Reagan, backed his decision by quoting the late conservative Supreme Court Justice Antonin Scalia, who wrote the majority opinion in a 2008 decision that overturned Washington’s ban on hand guns. The landmark ruling expanded individual gun rights but said the right isn’t unlimited.

"Weapons that are most useful in military service -- M-16 rifles and the like" aren’t protected by the Second Amendment and "may be banned," Young quoted Scalia as saying, referring to the automatic rifle popular with the military. The AR-15 is similar to an M-16, Young said.

I’m interested in reading more about the rational for declaring the AR and M16 “similar”. All guns are similar in one respect or another.

The ability to easily switch to full auto seems to be a significant difference to me.

"The AR-15’s present day popularity is not constitutionally material,"
. (U.S. District Judge William Young)

Yes, AR-15 and M-16s are not the same, yada yada, bla bla. But an AR-15 can be used to kill lots of innocent people very quickly. They just don't belong in civilian hands, no matter how fun they may be at the range or ... hunting deer ... or... ?? I actually can't think of any good uses for these boom sticks.
