Democratic Party files lawsuit alleging Russia, the Trump campaign and WikiLeaks conspired to disrupt the 2016 campaign


he Democratic National Committee filed a multimillion-dollar lawsuit Friday against the Russian government, the Trump campaign and the WikiLeaks organization alleging a far-reaching conspiracy to disrupt the 2016 campaign and tilt the election to Donald Trump.

The complaint, filed in federal district court in Manhattan, alleges that top Trump campaign officials conspired with the Russian government and its military spy agency to hurt Democratic presidential nominee Hillary Clinton and help Trump by hacking the computer networks of the Democratic Party and disseminating stolen material found there.

“During the 2016 presidential campaign, Russia launched an all-out assault on our democracy, and it found a willing and active partner in Donald Trump’s campaign,” DNC Chairman Tom Perez said in a statement.

The standard in civil court is more likely than not. The standard in criminal court is beyond a reasonable doubt.

nothing about the rule of law, and they are party before country and don't give a shit about the average Americans nor their rights nor economic woes.

The current GOPs want a dictatorship not a democracy. They need to the stopped. We no longer can trust them to protect the USA, they have been compromised.

Although it's a civil suit, discovery is gonna be a disaster for the Republican Party.

Strategy: Brilliant legal + political

Civil lawsuit:

(a) forces production of documents and

(b) compels testimony from witnesses.

Witnesses in a civil suit might have to plead the 5th Amendment. This could be damaging politically. Also in civil suit, jury may draw an inference of liability from a person’s assertion of the 5th Amendment right to remain silent.

Civil suit also blunts Trump’s threats to fire Mueller + Rosenstein and efforts by Nunes and others in Congress to sabotage the Special Prosecutor’s investigation - civil suit means issues are not going away.

I didn’t read the lawsuit but what is the relief it s seeking? Usually file lawsuit for money damages or specific relief like an injunction or declaratory judgement but here what is the plaintiff’s damages. Punitive, compensatory or both. Very interesting idea but I don’t know how far they are going to get with the case. I hope they bankrupt the defendants.

That is the main story here, I believe.

The DNC, as a civil plaintiff, will face a lower standard of proof than would Mueller or any other prosecutor in a criminal case (see #9 by DemocratSinceBirth).

Trump can thwart any federal criminal prosecution by issuing a pardon. By contrast, a pardon has no effect on the pardoned person's civil liability.

It's not all peaches and cream, though. Posters in this thread that look forward to discovery should remember that discovery goes both ways. Until now, the DNC has preferred to keep confidential some of the information pertaining to the breach of its server security. In this suit, the defendants will have a pretty broad license to explore the DNC's internal workings, including the inspection of its servers.

Of course, that assumes that the case reaches the discovery stage. There will certainly be motions to dismiss. For one thing, some of the counts seem to allege intentional torts. For most of those, the New York statute of limitations is one year. There are "tolling" rules that can extend the deadline, and the statutes of limitations of Virginia, the District of Columbia, and the cited federal laws will also come into play. There will be a lot of legal research to be done. Several fine homes in Westchester may be built out of this case.
