A black Brooklyn lawyer and her biracial daughter claim they were wrongly accused of shoplifting by the white clerks in a Williamsburg vintage clothing store and then handcuffed by cops.The mother-daughter day out last Friday ended with a bruised and cut Nancy Bedard and her college-age daughter at Woodhull Hospital after a store worker called the police.
"My daughter and I were hysterically crying," said Bedard. "My daughter, my baby, had to go through this and had to deal with all these lies and harm to her physical body, as well as to her emotional state."
The NYPD said an internal investigation led to the transfer of the patrol supervisor until the probe is finished and an admission from a store worker that she was unsure anything was ever stolen."The two women were detained for a brief period of time," the NYPD said in a statement. "During that investigation, no (stolen) property was found and the store employee became uncertain that the two individuals removed any property."
When the dress shop worker warned that a surveillance camera would have captured any theft, Bedard encouraged her to review the video.The woman instead called the cops and followed the lawyer and her daughter, who was home from college for a relaxing weekend before final exams.The NYPD confirmed they were called with a reported "larceny in progress" at the Bedford Ave. store.
When police arrived, the mother and child were handcuffed together and cops looked through one of their shopping bags.After finding nothing, the police uncuffed Bedard and her daughter, who had suffered bruises and cuts from the cuffs.
Police confirmed the two women were accused of theft and that neither had any stolen property.But Lou Turco, head of the Lieutenants Benevolent Association, said the patrol supervisor was not transferred after the incident.
The mother and daughter were taken to Woodhull Hospital, where they say police continued to shadow them. It wasn't until 11 p.m. that police returned her driver's license.About 60 people showed up at the shop Friday night to chant, "This is your block, stop calling the cops" and "stop racial profiling."For Bedard, the encounter illustrates how bad race relations in the country have become."It's while we're shopping, drinking coffee, sleeping, selling cigarettes," she said. "The fact that you're black alone is suspicious."

I too hope she sues the store owners, and maybe the NYPD too. But she shouldn't HAVE to. These days it is lucky the cop didn't have an itchy trigger finger. Lots of African Americans have been shot and killed by gun-happy cops for a lot less.

(4,079 posts)The opening clause of the sentence should have either been written as "Once the police arrived..." or it should have been moved to the predicate, perhaps right after "handcuffed together."
Better yet, the author could have used the active verb "handcuffed" instead of the passive "were": When police arrived they handcuffed the mother and child together...
Just my two cents.

It's bad enough they handcuffed them.. with only the say so of the worker who was paranoid of women shopping while Black.. evidently!

(58,724 posts)On May 4, a misunderstanding ensued inside our store which quickly escalated. One of our employees politely approached two patrons to clarify a situation, which was immediately countered with the accusation that our intentions were racially motivated. Shocked, our employee pursued them outside in an attempt to sort things out. At this point, one of the patrons threatened our employees safety, humiliated her and berated her race, class, and physical appearance. The NYPD were called at the suggestion of these patrons, as well as our employees who hoped they could help to diffuse the issue. The patrons were uncooperative. What happened after that was beyond our control.
Since then, the patrons have proceeded to defame our company. It is devastating to see our small company and our names smeared and boycotted, especially when the incident did not happen the way it has been portrayed.
We have made numerous efforts to contact the patrons to try to resolve this. Once we were unsuccessful in reaching them, we responded directly to the patrons husbands original Facebook post, with:
We could not be more sorry or regretful for the encounter that happened at our store, for the incidents that ensued after, and for the way the police treated your beautiful wife and daughter. This is not the way Amarcord does business, and this does not reflect the ethos of our company as a whole or us as people. Amarcord loves and embraces all cultures, ethnicities, races, and genders. We do not tolerate discrimination of any kind, whatsoever. In fact, we condemn it. We have been trying to get in touch in other ways, but we have been unsuccessful. We want to make amends, make things right, and make it up to them. It would be a privilege to be able to speak with her and apologize personally, please email me, Patti (the owner), at us@amarcordvintagefashion.com. We sincerely hope to hear from you.
Unfortunately, our statement was promptly deleted.
If you know our team, our store, and us personally, you know we are inclusive, progressive, hard working, decent human beings, who actually stand against discrimination. We do not, and have never tolerated discriminatory behavior of any kind. We love and welcome all our customers, and have been enjoying their support for 20 years. Throughout this time, we have never been accused of this. This should speak volumes about who we truly are.

I will echo a comment about doxxing to put some level of blame on the employee. That's the only way a person can start to understand the effects of their action. Being fired from this establishment is not a big deal. Having a history following you around for years is.

They called the two patrons "uncooperative" and "furtive," suggested that they were lying, accused them of "threatening" their employee's safety, and then of "humiliating," "berating" her. The employee, on the other hand, is described as professional, patient, and simply doing what anyone would have.
THEN they ask for a meeting to try to "resolve this."
How fucking pretentious of them. I, too, hope this is "resolved" in court.

There is also a huge difference between that statement and the other statements by the store so which version are we supposed to believe.
Why didn't the cops look at the store video? Plenty of mistakes made by both the store and the cops.

(37,648 posts)Poor woman. I bet that was humiliating and traumatic. The clerk should have reviewed the video before calling the police, since she had the identities of the shoppers, I assume. She should not have called the cops unless she was sure, though.
I wonder what she thought she saw. All the stores, esp small ones, keep an eagle eye on inventory because there's a lot of theft. I count, or clerk counts or notes, # of items I take to try on, then I return everything in most stores, counting the ones I'm buying. Everything is right there, accounted for.
But some stores are more loosey goosey on that, when you leave items in the dressing rooms & just take the ones to buy to the register.
In discount stores, you get a number on a tag to indicate the # of items you are trying on. Then you have to return them all to the clerk, along w/the tag #, so they can see that all items are accounted for.
If someone had stopped me, I would have said I don't have any other items than what I paid for...and I would have opened my purse for them to see, to satisfy them. I would have been angry about it, but I wouldn't have just left, I think.
I'm sure racial profiling goes on, whether intentionally or unintentionally. I've had attempted break-ins by youngish men before (one white, one black). Because of that, I would be more leery of a youngish male approaching my door than someone else. I suppose that's a sort of profiling? But it's based on my personal experiences, so I can't really help it.

The lawyer said she started raising her voice, She was causing a scene, he said. The police were called when she was in the store when we didnt know if she would leave, the Daily News reports.
Kron claims that his clients did nothing wrong, or as he puts it, nothing that was racially motivated and that the question about the phantom garment was a normal question for any retail business.
The story from the patrons:
I remember counting on my fingers. One, two, three, four. There is no missing item, the lawyer told the Daily News. Bedard tried to leave the store when the clerk reportedly followed her and her daughter outside.
She told me to come back in the store and I wouldnt, she said. I know my rights and I didnt.
The clerk warned both women that the store had surveillance cameras that would have captured any theft.
Great, Bedard said she told the clerk. You should go watch it.
Bedard claims that the woman then followed her and her daughter, who was home from college, and called the cops. Bedard also claims that the woman berated her and her daughter while waiting for the police to arrive.
They knew you were going to shoplift the minute you walked in the door, the woman reportedly told Bedard and her daughter. Thats why they called me.
It was very embarrassing, Bedard told the Daily News. People were staring at me, not her, but she was the one that was screaming.
Another account:
After trying on several outfits, Bedard says a white Amarcord employee accused the pair of shoplifting. Bedard denied the claim and even counted all the items they had tried on before exiting the store, but another employee chased her down the street.
"She kept following us and she tried to touch me, and I told her not to touch me - I told her she was harassing me. I then took my phone out and tried to take her picture, and she tried to grab the phone, but I did take a photo of her and I said 'please leave me alone!" Bedard added.
A practicing attorney, Bedard believes she was racially profiled and says the employee unleashed a series of verbal attacks while following her and her daughter down Bedford Ave. Police were called a short time later and Bedard says what happened next added insult to injury.
So, I'm confused. If the store's right, we'll have witnesses. If the patron was right, we'll have witnesses.
If the store is at all correct, their surveillance video can confirm whether they left the store before 911 was called, as they claim.
They can release the video showing whether there was an altercation inside the store.
Unless they do, I'm far more inclined to believe the lawyers who know exactly what the penalties for defamation are.

And of course, belief based not on fact but on assigning guilt by color is intrinsically intensely biased. That shouldn't have to be said. Nor should anyone have to point out, yet again, that tendencies to both racist bad behavior and other obnoxious acting-out behaviors are human characteristics common to people of all colors and backgrounds.

(8,311 posts)I'm arguing that two lawyers who know exactly what the penalties would be if they were lying about this, it was proven, and a business won a civil suit against them, are the people I'm more likely to believe than the people who are sitting on evidence that could completely exculpate them, if their side is true.
I do want to hear more.
I also do see some similarities in both accounts.

Mom tries on four items, asks the price, leaves them on the ottoman, starts to leave having not made a purchase.
Approached while leaving, asked about a fifth item, points to the four she tried on, says no fifth. Exits and is followed out, told to come back in.
"No, how could I help you?' after she's already accounted for items.
"You stole from us'.
"No, I haven't stolen anything from you. Cause Im black you think Im stealing?
"The surveillance cameras will prove any theft!"
Great, You should go watch it. Starts walking away, is being followed.
Cops arrive, handcuff two women instead of just asking to see their bags, etc.

Now, beyond that, we don't know if both parties were yelling or just one. If Nancy actually does have a picture of the woman trying to touch her, that could suggest that the store employee went beyond "Shopkeeper's Privilege" by attempting to use physical force to detain her there. And the reasonableness factor -- if they did in fact review surveillance before following her -- may also go against the business.
But I really think most people know better than to lie to get their 20 minutes of fame. Especially educated people.
So yes, I believe Nancy.

(58,785 posts)for years, Moriah, would never (omg! ) automatically consider anyone more ethical, honest, reliable, or afraid of engaging the legal sysem because he or she is an attorney. All competent attorney's know how manipulate facts, words and processes to use our legal systems as both defense and weapon.
And unless you have the power to match him or her, taking on one who is threatening you legally is as begging for trouble in its way as challenging a bad police officer. I've been threatened twice as an independent subcontractor in my field and backed off twice though I was completely in the right and both were in the wrong. They both knew it, but they both also knew that legal costs would be very expensive for me and very low for them, and that they could drag it out punishingly. The same tactics Trump and Cohen used routinely.
As for the rest, I still feel not the slightest need to form an opinion now and will wait and see.

(58,785 posts)Sure, that nothing was found when the police searched seems to speak very loudly. And not that these customers are guilty of "looking evasive" while being black. That sounds damning, but shouldn't we have the story before sentencing?
The reason I spoke up is the leaping to fact-free assumptions by most on this thread. God forbid anyone behaving that way were on a jury for me, or anyone. To that note, btw, I suspect a recital of behavior on this thread -- followed by a proud statement of intention to repeat it any time one feels like it -- should help anyone get excused from service.

either way.. when I worked in retail you didn't get to go after someone once they left the store. You had to confront them on the spot. AND you sure as hell better be absolutely sure you saw them do it. I hope they clean bankrupt that store with lawsuits.

What's interesting is that she's saying her ID wasn't given back to her until after she was treated at the hospital for the cuts from the handcuffing, despite them having no reason to detain her.
Retaining a person's photo identification is de-facto detention. Why was it retained? Is that why he's getting transferred, more than the fact he handcuffed shoplifting suspects?

A smart officer would have handed over the IDs immediately, even if they did decide to go to the hospital as well, to avoid the perception of detention. A dirty cop knowing he used excessive force and trying to intimidate witnesses would hold it.

A smart officer would have let her go 2 minutes after arriving at the scene and seeing their was no evidence. Then lectured the woman who made the call.

As it is, the big box stores here require I have my receipt out to show to employees at the exit to verify the purchases in my bag/cart before leaving the store.

The folks at the shop were unsure at that point that anything was stolen, but the mom and daughter still got handcuffed and detained because they were angry. And why wouldn't they have been angry.

(54,379 posts)Here in Germany, one of my wife's friends was shopping in a sleep shop. She was shopping for some new sheets and covers. Her husband is the retired head of a huge successful firm and worth a fortune. She is a retired teacher from a working class Ruhr Valley town. She talks like it and dresses like it, and sees no reason to show off her husband's money. So she dresses in simple shirts and jeans. She went into a sleep shop and after looking around,told the saleswoman she wanted to take a close look at one certain set of bedclothes. The saleswoman told her, "oh, those are too expensive for you." Now, she could have bought the whole store if she had wanted to, but just told the saleswoman to let her be the judge of what she could afford and what she couldn't.
For that matter, I was in a "Reform Haus" shop (bio foods etc.) in my town a few years ago, and had nothing smaller than a 100 euro bill, so I tried to pay for my purchase with that. The elderly woman at the cashier started screaming at me that she knew a fake bill when she saw one, and that "she didn't know from what country (i.e. you dirty foreigner) I got my paper money from," but she knew there was no such signature of the euro bills. I looked. The signature on the bill was that of Jean-Claude Trichet, who had been head of the European Central bank for about a year and a half. Bills with the signature of the first chairman, Wim Duisenberg, were still circulating, and after a year and a half this idiot woman hadn't noticed the new ones--and she was working as a cashier!! I was so furious that I walked down to the local police station and swore out complaint that I had been falsely accused for being a foreigner trying to circulate fake money. The cop on duty looked at the bill in question and asked what the cashier had found wrong with it. I said she was cursing me out (and she was really yelling) because the signature of Jean-Claude Trichet didn't exist. The cop rolled his eyes, and asked if it would be enough for me that he send someone to have a talk with the cashier. I said that would be fine, and I found out later that not only had the police had stern words with her, but the head of the chain had sent a reprimand as well. They apologized to me and said they certainly didn't condone such behavior.
The difference is that here in Germany, words are exchanged. In Trump's America, the cops would have probably arrested me, put me in custody for a day or two, and then, after finding that my currency was genuine, confiscated it to finance their next barbecue.

I have no problem believing police have often been used as a weapon against PoC, and that in the Age of Trump racists are emboldened. I also think (and this is probably good) that since the Starbucks incident we are talking more about these issues.

(128,979 posts)so IMHO, it is just getting "reported" more. The frequency may actually be "less" in certain places due to more enlightened people but may be "more" in other places due to people stoked by the current occupant of the WH.
And note that most of these reports ARE being done on social media initially and the only way they make the "news" is if they "go viral". I.e., simply reporting these incidents directly to the local news outlets would get the report eventually placed in the "circular file" unless the incident was egregious (like a death by cop) or involved a celebrity.
And yes, police are the private security of many whites, despite POC paying taxes for those same police. It is up to PDs to encode and enforce policies that will determine if the call was "unfounded" and to de-escalate any dispute, and finally to LEAVE.
There is a tendency for LEO to stand quietly while whites "mouth off" and vent at them (allowing them to "blow off steam" when confronted, but POC must remain silent and docile in the same situation or they will be beaten and brutalized before being arrested, or even killed on the spot, and then dragged away dead to be thrown in the back of a police cruiser or left on the street for hours before the coroner arrives.

One on the young man being roughed up at the Waffle House and the other of the lady being yanked from her car in Atlanta. Interesting that they both immediately asked for the Supervisor to be brought in. (Police Supervisor)
As a white male, that is something I would never have considered, a bit of white privilege, we don't have to ask to move up the chain of command because we don't get yanked from cars during a traffic stop.
