but she injures no one other than herself and her child and risks injuring no one other than herself and her child. She is breaking a law, but there is no potential for a victim.

If you drive drunk or break most other laws, you not only break that law but you either injure something or another person or you risk injuring something or another person. There is a potential or real victim.

That is why it is not right to separate a child from his or her mother for crossing the border, but it is OK to separate a child from his or her mother if she or he commits a crime that could have a victim -- like bringing drugs across the border or, if you are a politician, accepting donations from a foreign country and thereby gaining an advantage over your political opponent.

The Eighth Amendment (Amendment VIII) of the United States Constitution prohibits the federal government from imposing excessive bail, excessive fines, or cruel and unusual punishments. The U.S. Supreme Court has ruled that this amendment's Cruel and Unusual Punishment Clause also applies to the states.
