Republicans are so radicalized they no longer feel constrained by even the faintest notion of norms or precedents. Stare decisis is a punchline for them. If there is no one to physically stop them from doing something, they will do it. Roe v. Wade is as good as gone, along with Obergefell and every other wingnut bugaboo, from Obamacare to prayer in school and Brown v. Board.
This also means that they wouldn't hesitate, not for a second, to pack the court if they found themselves in our position (it took McConnell all of five minutes to overturn the supposedly sacred filibuster for SCOTUS nominees). So we've got to get past our self-imposed "when they go low we go high" restraints and start coming to terms with reality. Once we're back in power and public outrage starts building over the country's return to Puritan-era social policy, we'll be the ones getting blamed because that's how this electorate works: Republican lunatics break things, and Democrats get blamed for not fixing them fast enough (because "both parties are the same" and yada yada). If we're not ready to play the game with the same level of ruthlessness as the Republicans, then we might as well surrender now.

(4,611 posts)Which will, ironically, work to our advantage because it will give Trump's SCOTUS a year or two to really scare the shit out of apathetic 'both parties are the same" voters.
