What if Mueller decides to subpeona or indict trumpass on Aug. 1??

Does the USSC have to take it up before a new justice is sworn in?

If so, would that person be expected to recuse him/herself? Does Gorsuck have to recuse himself??

It is voluntary and dependent, on the justice themselves, though I'm sure Chief Justice Roberts would pressure a liberal justice with conflict (though never a conservative).

It would likely take time before the USSC would hear a case, even if expedited, but the pressure would be on Congress to impeach in the meantime. All this coming before the election would be quite the chaotic CF.

They are in recess. So, this would not happen until next year. Next term will start this fall, late October or early november.
