(15,290 posts)the federal bench. Supposedly Kavanaugh came to this revelation after serving with Ken Starr on the Clinton investigation/impeachment. However, O'Donnell pointed out Kavanaugh writes in the same article that only Congress can protect the president by enacting laws that specifically say a president cannot be bothered by civil suits (that happen before becoming president) or be made to testify to prosecutors or defense while in office.

Will this galvanize at least one Republican to block this nomination...
I'm no lawyer, but even the lawyers are sausage making over what comes after the Special Counsel report.
I can't even... depressing... gotta get to bed.

(26,060 posts)kavenaugh was referring to criminal cases resulting from what was a civil matter (jones v Clinton). He doesn't think civil cases should be allowed during a presidents term. But when it came to the perjury and obstruction charges against Clinton, he was all for it. mueller is not about a civil matter. Criminal all the way. As far as I can tell, kagen aught has not commented or ruled on something like this.

(15,290 posts)to protect the president from criminal matter while in office, as well, in the same article. He thinks it's just too disruptive for the president to have to deal with personal civil or criminal legal matters while in office.
His argument is that impeachment is the remedy for presidential misconduct which clearly it is. However, the founders surely did not anticipate the willful dereliction of duty by the co-equal branch of gov't - Congress - in holding the president accountable.

(26,060 posts)but that's not this judges fault. My bigger worry is his feelings about special counsels or prosecutors because that's what I see is going to be the issue the republicans will hang their hats on - that the entire investigation should ONLY be handled by congress.
