Let's start off by understanding that Giuliani is a moron. Next, the NY Times broke a story that the White House Attorney Don McGahn was interviewed 3 times in the last 9 months for over 30 hours about the President's involvement in the obstruction case with no restrictions. Now, either McGahn gave that story to the Times or a very close associate did. There would be no incentive for that info to come from Mueller and it would certainly be out of character for his team to leak it.
But the real proof that it's McGahn is the CNN reporting that McGahn gave no incriminating evidence against the President* could come from no one other than Don McGahn, himself. That statement was made by McGahn to CNN (my theory) to placate Trump. There is no way McGahn spoke to the Mueller Team for 30 hours without incriminating the President*. Just the Air Force 1 statement about adoptions would be incriminating. The Flynn stuff. The Comey stuff. The Sessions stuff. CNN is accurate that a reliable source (McGahn) gave them the story, but McGahn is lying to them that he gave nothing to Mueller.

(62,444 posts)It is hardly new that "a confidential source" has information about goings-on in the White House in which McGahn is the shiny hero.
It is also hardly difficult to figure out where these stories may originate, given how consistently he is depicted as the hero.

Anything McGahn has told Mueller would have to be hearsay evidence because he's not a party to it, he just heard about it from Cheeto or another person involved. Mueller's team still has to corroborate everything because one person's testimony doesn't amount to much. That's probably how McGahn sees it anyway.
I'm not a lawyer and I don't have any insider info, other than what I've read here on DU.

(8,652 posts)...it's the best evidence to Trump's "state of mind" during all his actions that could be obstruction. The act becomes illegal if Trump Fired Comey "with corrupt intent", interfered in the Flynn investigation "with corrupt intent" or wrote a false statement to clear his son "with corrupt intent". That intent can be ascribed to Trump by any conversation he had with McGahn.
