The Supreme Court said a civil suit can be brought against a sitting president as an individual for acts done before he took office and were unrelated to his presidency. But that was an ordinary civil case brought against a president personally. Brennan's lawsuit would be against the president as president (that is, against the representative of the government) claiming his constitutional rights were violated, and there's no prohibition against suing a president acting as the representative of the government for violating the Constitution. Right now there's a lawsuit in progress claiming Trump violated the Emoluments Clause.
