What is impeachment?
At the Constitutional Convention of 1787, the delegates concluded that even those holding the highest office would not be above the law, birthing the American system of impeachment.
Under the Constitution, the president, the vice president and all civil Officers of the United States (including those in the executive branch, plus federal judges) may be removed from office for treason, bribery, or other high crimes and misdemeanors. The procedure for impeaching a president or a federal judge is broadly the same.
There are two parts to the process:
The House is entrusted with the responsibility of voting on impeachment. Its members decide by a majority vote.
Then the Senate holds a trial for the underlying misconduct. A conviction requires two-thirds of the Senate, or 67 votes. If there is a conviction, the Senate removes the individual from office.
How likely is Kavanaughs impeachment?
Its as likely as the Democrats winning the House, said Jed Shugerman, a professor at Fordham University School of Law.
If they take back the House, I would be surprised if they dont put forth impeachment proceedings in the next Congress, Shugerman told The Washington Post.
At the moment, according to the Cook Political Report, Democrats are substantial favorites for House control.

(1,058 posts)but the Senate will never convict and remove him, the numbers are just not there and won't be for a long time.

Better that they should subpoena every last Republican in congress down to the file clerks and have them give sworn testimony in hearings chaired by the new Democratic majority is open session so the public can see what they've been up to in their name. The media headlines ill do a better job of skewering Republicans than an abreviated impeachment process.

When people are enraged things happen.
I remember in 1992 we lost almost all the republicans in our states delegation.
I think there was 1 left.
ANYTHING CAN HAPPEN.

(7,412 posts)That would be up to the DOJ. The House committees really have very little power, even if someone ignores a House subpoena and is held in contempt of Congress they can only refer it to the DOJ for prosecution and they can just ignore it.

I'd love to see him deposed by an opposing, practicing attorney (with all due respect to our Senators).

Just ask the pubs how well it went for them when they tried to impeach, try, convict and remove President Clinton.

(25,586 posts)A total waste of time and self-destructive to boot. We gain nothing from an impeachment without conviction and end it looking weak and ineffective. Thats energy best spent elsewhere.

(22,600 posts)then by all means, impeach everybody in sight and spend a lot of time doing it.
Yeah, that'll show them, especially when there is ZERO chance of conviction in the Senate.

(25,183 posts)A month from now, the name Kavanaugh will disappear from the news. I'm dead certain that we will have at least two things that Trump will move to the center of focus by then. And then, there are the midterms. Let us hope that things turn out well.
