judge upholds 'Stand your ground' defense in teen's bus stop stabbing death
NAPLES A 15-year-old who stabbed a classmate to death will not face murder charges.
A Collier judge has upheld the "Stand your ground" defense in the case of Jorge Saavedra, who stabbed Dylan Nuno to death last January at a Golden Gate Estates bus stop.
Dylan Nuno's mother, Kim Maxwell, called Collier Circuit Judge Lauren Brodie's decision "unbelievable."

This court concludes that the defendant was in a place where he had a right to be and was not acting unlawfully. He Had more than enough reason to believe he was in danger of death or great bodily harm, the judge's ruling read. Under current Florida law, the defendant had no duty to retreat... The defendant was under attack from the first punch to the back of his head until he stabbed Dylan Nuno.
The order grants Saavedra, now 15, immunity from further criminal prosecution as well as from any eventual civil action regarding Nuno's homicide.

(26,582 posts)Saavedra got off the bus early, was followed by Nuno, punched in the back of the head repeatedly while Nuno's friends urged him on. Saavedra said he only pulled out the knife after he started feeling light headed. Other students backed up that Saavedra was bullied by Nuno and that Nuno said "today's the day".
It's sad for Nuno's family that he died, but when you attack someone getting stabbed could possibly be a consequence of your actions as it was in this case.

(34,172 posts)I'm glad the Stand Your Ground Law helped protect Jorge Saavedra from unnecessary prosecution and civil litigation.
I hope Jorge is able to move on with his life
