Trump argues in court filing that he can limit journalists' access to White House



(CNN)The White House asserts that it can pick and choose which journalists are given a permanent pass to cover it, according to a court filing by the Justice Department on Wednesday.

The filing was the government's legal response to CNN and Jim Acosta's lawsuit over the recent suspension of Acosta's press pass.

Tuesday's lawsuit against President Trump and several of his top aides alleged that the ban violates CNN and Acosta's First and Fifth Amendment rights.

Most of the country's major news organizations have sided with CNN through statements and plan to file friend-of-the-court briefs.

if he blocked CNN as an entity, that's clearly a First Amendment issue...but blocking a specific reporter?
I don't know if that's a First Amendment issue.

3. generally speaking, you can do that sort of thing, but you can't base such decisions on speech.

if they ban a reporter because they ask questions they don't like, that's a first amendment problem.

if they ban a reporter because they refuse to shower, that's no problem.

first a bogus issue, then later that he refused to give up the microphone.

They won't admit it's because of questions they don't like, then again they can simply refuse to ever call on him again if they want to.

8. the claims are obviously bogus. any reasonable judge would have a field day with the doctored video

he gave up the microphone, just not immediately upon an unidentified person trying to grab it from him without asking. hard to call that something that should get someone banned from the premises. any reasonable judge would easily see right through that.

but of course there are also partisan right-wing judges as well....


you're right, of course they can choose to call only on "safe" questioners, plants even. that quickly becomes obvious, and in normal times the media wouldn't let an administration get away with that. these days, who knows.

and that's pretty clearly what happened here.

even if you buy the ridiculous argument that it was about his "behavior", keep in mind that the white house started the brouhaha by rudely trying to grab the microphone away from him, which itself is a silencing act and bad behavior. whatever "behavior" they object to came only after they tried to silence him.

that's a real problem in a first amendment case.
