Trump Defender Alan Dershowitz Argues That Lying To The FBI Isn't A Crime

Al needs to retire from public life or go work for the internet research agency since he is already a shill for Putin's thugs.

“Flynn did not commit a crime by lying,” Dershowitz said during a Fox News interview Monday. “The lie has to be material to the investigation. And if the FBI already knew the answer to the question and only asked him the question in order to give him an opportunity to lie, his answer, even if false, was not material to the investigation.”

“Lying to the FBI is not a crime,” Dershowitz added.

It should be noted that lying to the FBI is indeed a crime when the falsehood in question is material to an investigation, and prosecutors have determined that Flynn’s statements were.

“I think the judge has the authority to throw out the plea if he believes that the plea was not to a crime, and I think he should find, as a matter of law, that when you tell an untruth to the FBI about a matter that they already know the truth about, they already know the answer, when the only purpose of the question is to get you to lie, that that’s not a crime.”

Why would that prosecutor have gotten a cabinet position in the Trump administration? Why is Dershowitz suddenly Trump's biggest fan? I hope the judge allows that case to be opened back up for resentencing.

Gordon Chavez, 36, a former probation officer with the New Mexico Corrections Department’s Division of Probation and Parole, was sentenced today to 18 months in federal prison followed by three years of supervised release on charges related to the sexual assault of a probationer whom he supervised. Chavez previously pled guilty to one count of violating the victim’s right to bodily integrity when he touched her breasts against her will. Chavez also pled guilty to one count of making material false statements to the FBI when he denied both touching the breasts of females whom he supervised and asking for naked photos of them.

There was a recording of him talking about his sexual assaults, the FBI had it. He denied it. He was still charged with lying to the FBI. And he went to prison over it along with his sexual assaults.

But other legal experts quickly pointed out that Dershowitz was distorting the facts and misleading the public.

“Here’s [Dershowitz] making an argument about how the law SHOULD be, but concealing it as an argument about what the law IS,” said attorney Ken White, referring to the Fox News interview.

His point was that Dershowitz’s is arguing a point as if it weren’t already settled law. Dershowitz appears to believe that lying to the FBI about facts the FBI already knows should not be prosecutable. White even acknowledged that he agreed with this opinion, but pointed out that the courts have consistently ruled against this view. By presenting his opinion as if it were the law, White argued, Dershowitz was lying.

“Like many of Dershowitz’s recent statements, this appears to be a deliberate effort to mislead the public,” noted Renato Mariotti, a former federal prosecutor. “Dershowitz often misleads the public through sleight of hand like this. His deceptive phrases are so carefully worded that I’m convinced he is deliberately deceiving people.”

I thought these guys were the law and order folks? There's ENTIRE networks of the Nancy Grace types NCIS that is INSUFFERABLE after about a half-hour....that folks like this eat UP. But, just seem to let the shows basics escape them for convenience. You know, the law and order RULES etc.
America post-trump is a lie-fest for all the folks who do it and know they should'nt. Trump made lying ok in America....
but stand for the GD anthem you guys. And, go to church. Ahem.
