My suggestion for a new constitutional amendment for electing a president

I know, changing the constitution is a real chore. I also know, that any suggestion here is just shouting in the wilderness. But, having said that, here goes:

The Republicans and Democrats, and any other party can nominate a candidate for President. Each will appear on every ballot in all 50 states and the District of Columbia and Puerto Rico. The election will be held during the second week of September. Third party and independent candidates must qualify in each state, as they do now. Any party that receives greater than 5% of the vote in the September election will qualify for access to all 50 states, DC and PR for the next election cycle. If a candidate receives greater than 50% of the vote during the September election, he or she is declared the next President of the United States. If no candidate receives greater than 50% of the vote in September, the top two candidates will face off in a General Election held on the first Tuesday after the first Monday in November. In this amendment, we should also include national voting rights that each state must abide by. A voting rights act for all 50 states, DC and PR.

This election method solves four problems. (1). No third party candidate can act as a "spoiler". (2). The winner of the final election will be a candidate who has obtained a majority of the votes cast, giving that candidate increased validity. (3). It will bring into play the old axiom of one person, one vote and everybody's vote counts. (4). Safe guards voting rights and puts all states in a uniformed election format.

I know what your thinking, but I can dream, can't I.
