18 U.S. Code § 2102. Definitions

(b) As used in this chapter, the term “to incite a riot”, or “to organize, promote, encourage, participate in, or carry on a riot”, includes, but is not limited to, urging or instigating other persons to riot, but shall not be deemed to mean the mere oral or written (1) advocacy of ideas or (2) expression of belief, not involving advocacy of any act or acts of violence or assertion of the rightness of, or the right to commit, any such act or acts.

The Supreme Court has made it clear that the incitement provision is very narrow and only applies to speech that is "directed to inciting or producing imminent lawless action".

He has gone too far with this. It is not acceptable to threaten a majority of the people in your nation with bodily harm or death because they disagree with you politically. I am tired of these republican cowards in congress, they need to act by working toward his impeachment and conviction. He needs to be removed from office in order to save what is left of our democracy.

Now any law squelching speech has to pass the Brandenburg test - it has to have intent to produce lawless action (notoriously hard to prove, though given Trump's tweeting, it may actually be possible), be able to produce imminent lawless action (given the nature of stochastic terrorism, a statistician may help with this) , and it has to be likely to produce lawless action (again, consult the statistician, and show some video of Trump's Nuremberg rallies).

Difficult, but given Trump's arrogance and stupidity, not impossible.
