SDNY is federal. However, referring cases to various US Attorneys does make it uglier

The Southern District of New York is a division of the federal court system. However, whatever charges the Manhattan DA's office comes up with wouldn't be because they'd be state crimes.

to try to fire his way out of the problem, does make the prosecutions seem less politicized to average/poorly informed citizens, and does make potential adversaries of a larger fraction of the DOJ.
