Sheriff killer gets conviction reversed.

TOPEKA — The Kansas Supreme court announced Friday morning that it has reversed the capital murder conviction of Scott D. Cheever, the man convicted of killing Greenwood County Sheriff Matthew Samuels in 2005.

The unanimous ruling means Cheever will now get a new trial.

The Supreme Court said it reversed the capital murder conviction primarily because the district court allowed a psychiatrist to tell the jury about a court-ordered mental examination before Cheever had waived his Fifth Amendment right to avoid self-incrimination. The court let the psychiatrist testify about his opinions even though Cheever hadn’t used mental health issues as a defense, which would have been the trigger to allow the psychiatrist’s testimony.
