But Burkhalter, a resident of Hildebran, North Carolina, was prescribed a CBD oil that claimed to not have any THC.
She says she and her family saved up money for two years for their trip to Walt Disney World in Orlando.
Burkhalter says that when the family reached the checkpoint at the entrance to the theme park, she had her belongings searched.
A security guard found the CBD oil and alerted a sheriffs deputy, who arranged to have the oil tested.

(15,696 posts)When I said it was tobacco flavored juice, he said that was the right answer. And that was the extent of the issue every day we were there.
Sadly, Disney has banned all forms of smoking in the parks, & they're removed the few smoking areas that were available New Year's weekend.

Back in 2014, Florida passed legislation allowing for the use of CBD oil for a select few conditions (cancer, muscle spasms, epilepsy/seizures, and terminal illness), establishing what is now known as the Office of Medical Marijuana.
The program gained little traction in its initial stages, and its only been somewhat recently (early 2017) that qualified patients could begin legally purchasing CBD and other cannabis products from state-licensed dispensaries.
Currently, in order to buy CBD oil in Florida from a licensed dispensary, a patient must have a valid physician-recommended medical marijuana card (MMJ card).
However, few people know that Florida residents can also buy legal CBD without an MMJ card, as several companies operating under federal hemp legislation are now manufacturing high-quality CBD oils that are legal to buy, sell, and ship to all 50 U.S. states.

(17,865 posts)because they found traces of THC using an oil that was provided by my Aunt. She would kill herself if she didn't get them. She is a 74 year old woman with an inoperable abscess on her spine. Her insurance company was threatening to cut her off.
Yes she lives in Florida. This is the second time through on this opioid craziness for my family. My dad was at end stage colon cancer with at home hospice. He had those useless rub on pain medicines instead of an IV drip. That was in Louisiana.
It is a far different thing for a 70+ year old taking pain killers for these types of disease than a 30 year old.

Plus, it isn't supposed to have trace THC. If it does it is illegal, even in states other than Florida. Do I think the arrest and ultimately felony charges are absurd, yes. She should have been given an appearance ticket.
Again, what doctor (MD type) would prescribe (?) CBD oil? If her GP did, she needs to find a different doctor. I'm thinking it was chiropractor, naturopath, or homeopath (some quack).

(86,793 posts)we have medical marijuana and CBD availability and you can only have it legally in this state AFTER it has been prescribed by a doctor. We have cannabis dispensaries that were in existence years before CBD oils were readily available. It has only recently been decriminalized nationwide. Therefore, she may live in a state where it was only legal with a Rx. Idaho will do the same thing, test it and throw you in jail for illegal substance even though you'd have to drink te gallons of the stuff to maybe catch a buzz and at that point, it's probably something else you'd be feeling.
As for the trace THC... CBD hemp still contains up to .03%THC.
I work with a hemp farmer in the summer as a consultant so I have a little info about that. I have to have a medical card to handle the CBD hemp, well I did until a couple months ago.
ETA: My GP is fine with my use of cannabis and hemp for my arthritis even though it was prescribed by a different doctor. Since my GP works at a place which receives federal funds, they can't prescribe it so...

(3,813 posts)Also an NC resident here, and a long time sufferer of Chronic Lyme. For me, the disease and coinfections has proven resistant to antibiotic treatments, and managing the symptoms of cardiac complications, arthritis, pain, cognitive issues, and fatigue are ongoing challenges.
A specialist (MD) in Raleigh did put into writing that I should continue to use CBD as part of my overall supplement use. I wouldn't call it a "prescription," but his written recommendation is now part of my official medical records and workplace accommodations.
