Suspected sex trafficker Jeffrey Epstein was handed another break by the Department of Justice on Monday when federal prosecutors rejected his victims efforts to throw out his plea deal and prosecute him for abusing dozens of underage girls.
In the 35-page motion, filed in federal court in the Northern District of Georgia, federal prosecutors said that there is no legal basis to invalidate Epsteins non-prosecution agreement and they warned the federal judge in the case against doing the same.
U.S. Attorney Byung B.J. Pak said that because Congress did not outline specific penalties in the Crime Victims Rights Act when it was created by Congress, Epsteins victims have no right to demand anything from the government not even an apology. A federal judge ruled earlier this year that the plea deal violated that legislation.
In the filing, federal prosecutors did concede that the U.S. Attorneys Office in South Florida failed to treat Epsteins victims most of whom where 13 to 16 years old when they were victimized fairly, but they said that the law gives prosecutors discretion in deciding how to dispose of a case. Victims have a right to confer with prosecutors, but no rights beyond that, Pak said

Maybe that is why the Republicans hate abortion - fewer children to be abused.

By the way the US Attorney doesn't get to decide what Congress may or may not have intended, that determination is made by the courts...this needs to go all the way to the SCOTUS before this case is closed!!!

(82,849 posts)The dangers of the "everyone knows what we mean" legislation. Right now our government is arguing that because personal hygiene items and sleeping accommodations aren't specifically enumerated in the Flores consent decree, the government is under no current obligation to provide such in the concentration camps. Because the Crime Victims' Rights Act didn't specifically contemplate a corrupt prosecuting attorney who would fashion some bullshit argument about not notifying those victims that he was going to go easy on the perpetrator, it's totally all right. I'll bet there's something in Mr. Pak's argument implies that 13- to 16-year-olds don't have a sufficiently sophisticated understanding of criminal law to confer knowledgeably with prosecutors. This from the same government attorneys who argue that two-year-olds can represent themselves in immigration hearings.

As always, when contemplating a contribution to an organization you haven't heard of before, check them out on Charity Navigator, but there are several groups here that I've heard of and that do good work where our government is doing evil work.

(32,745 posts)... so why is a court in Georgia having anything to say about this? Are the federal prosecutors in GA even more corrupt than those in south FL? I hope not, but that's how this looks. Maybe Epstein's lawyers are shopping around for the most corrupt DOJ people they can find.
