I suspect Mueller is authoritarian enough that he'll do as he's told.
Hope I'm wrong and he has a sense of decency that will override his basic authoritarian impulses.

(26,760 posts)Special counsels have to comply with all of the rules and regulations of the DOJ as though he were a US Attorney - and any time he contemplates going outside those boundaries he's supposed to consult with the AG.
As an example - the "no indicting a sitting president" isn't a law. It's DOJ policy. The AG could change that policy.

But let's just ignore that this implies that there are rules to follow?
Note that Mueller reached out to DOJ for guidance related to privilege claims. Why would he do that if they don't apply to him now that he's a private citizen?

(7,800 posts)He said on MSNBC recently that those regulations were intentionally written so that at the end of an investigation the Special Council could resign from the Justice Department and then would be ABSOLUTELY FREE TO TESTIFY ANYONE THEY WANTED TO - with no restriction whatsoever from the Attorney General or the Justice Department.

(26,760 posts)He's a private citizen. There's nothing DOJ can do to keep him from testifying in general. That part is correct.
But the regulation certainly was NOT written (as an example) so that the SC writes a confidential report for the AG... and then it ceases to be confidential a month later when he resigns.

(3,245 posts)and whether or not the guidance letter came from a 'staff' person (not sure what level he was), the report and the work product is still the property of the DOJ.
If I'm not mistaken, this is the biggest difference between the Mueller Report and the Starr Report. Not sure about the Watergate report.
So, yes, I do believe Mueller will abide by the DOJ policies, however, there is more than enough evidence in the report that will bear fruit tomorrow, only because these things will come out of the shadows where they've been sitting for the past 3 months.

(46,758 posts)Maybe he never had those qualities. I know people, institutionalists, who were very good at following procedure and would shit themselves if they were even in the company of anyone who wasn't part of the inside circles.
Mueller is in retirement and he doesn't want to be removed from the "A" list of the Republican cesspool.
Of course, he's welcome to prove me wrong.
