is willing to give him.

I suspect Mueller is authoritarian enough that he'll do as he's told.

Hope I'm wrong and he has a sense of decency that will override his basic authoritarian impulses.

Special counsels have to comply with all of the rules and regulations of the DOJ as though he were a US Attorney - and any time he contemplates going outside those boundaries he's supposed to consult with the AG.

As an example - the "no indicting a sitting president" isn't a law. It's DOJ policy. The AG could change that policy.

Snip-"As a private citizen, former special counsel Robert Mueller is not bound by assertions of presidential privilege, but he is known as a rule follower who is unlikely to defy the administration’s directions to limit his testimony."

Tomorrow is a crap shoot, IMO. Mueller could go Alexander Butterfield(Watergate) or Caspar Weinberg(Iran Contra)

Do you really think that a retired US Attorney is suddenly no longer bound by the rules of the DOJ? That a county prosecutor can suddenly start sharing grand jury information once she's no longer a prosecutor or gossip about ongoing prosecutions?

"As a private citizen, former special counsel Robert Mueller is not bound "

So says the photographer for Getty Images. What does he know?

he is known as a rule follower

But let's just ignore that this implies that there are rules to follow?

Note that Mueller reached out to DOJ for guidance related to privilege claims. Why would he do that if they don't apply to him now that he's a private citizen?

17. It DOES matter - according to Neal Katyal who wrote the Special Council regulations

Jul 2019

He said on MSNBC recently that those regulations were intentionally written so that at the end of an investigation the Special Council could resign from the Justice Department and then would be ABSOLUTELY FREE TO TESTIFY ANYONE THEY WANTED TO - with no restriction whatsoever from the Attorney General or the Justice Department.

He's a private citizen. There's nothing DOJ can do to keep him from testifying in general. That part is correct.

But the regulation certainly was NOT written (as an example) so that the SC writes a confidential report for the AG... and then it ceases to be confidential a month later when he resigns.

It’s what usually Republicans do. Mueller looks exhausted and not up for any kind of a fight. Since he explicitly follows the rules, he will obey his orders.

and whether or not the guidance letter came from a 'staff' person (not sure what level he was), the report and the work product is still the property of the DOJ.

If I'm not mistaken, this is the biggest difference between the Mueller Report and the Starr Report. Not sure about the Watergate report.

So, yes, I do believe Mueller will abide by the DOJ policies, however, there is more than enough evidence in the report that will bear fruit tomorrow, only because these things will come out of the shadows where they've been sitting for the past 3 months.

Maybe he never had those qualities. I know people, institutionalists, who were very good at following procedure and would shit themselves if they were even in the company of anyone who wasn't part of the inside circles.

Mueller is in retirement and he doesn't want to be removed from the "A" list of the Republican cesspool.

Of course, he's welcome to prove me wrong.
