that he's trying to thread a legal needle and the nuance will be lost on many, but I don't believe he's wimping out at all.

He's a prosecutor who believes he is bound by the OLC memo. In his mind, if he can't charge and allow the target his / her day in court, he shouldn't accuse.

He's told everyone repeatedly, I can't charge, so I won't accuse, but I would clear him if I could.

And, his answers to Chairman Nadler were clearly given with his comfort level of emphasis.
