Sullivan, 376 U.S. 254 (1964),[1] was a landmark decision of the U.S. Supreme Court in which the Court ruled that the freedom of speech protections in the First Amendment to the U.S. Constitution restrict the ability of American public officials to sue for defamation.[2] Specifically, it held that if a plaintiff in a defamation lawsuit is a public official or person running for public office, not only must he or she prove the normal elements of defamation—publication of a false defamatory statement to a third party—he or she must also prove that the statement was made with "actual malice", meaning that the defendant either knew the statement was false or recklessly disregarded whether or not it was true.[3][4]

But the text of the ad is vague enough with respect to him that they might be able to weasel out of a claim of defamation as to him. Since the target is Joe and not Hunter the really foul allegations are aimed at Joe.

Via Ukraine. As if he and Giuliani are the hero’s who uncovered corruption.

Trumpworld expected Biden to be the nominee last spring, so they set about the business of manufacturing unethical behavior and corruption in the Ukraine. The whistleblower messed up their timing, so, now they have to defend themselves publicly by spreading their own narrative. The news media isn’t helping them this time, so, not surprised they started running these ads to get their storyline against Biden out.

This isn’t an electoral politics ad, this is a buy what we’re selling ad - and they’re selling their excuse to do Putin’s bidding reUkraine.

President Trump asked a foreign government to interfere in our elections, and now he's spending $10 million on attack ads against me. It's clear that he is trying to influence the primary and pick his opponent.
