(82,849 posts)Republicans have been stacking the courts for decades to overturn decisions they don't like. We'll see how "the President is above the law" argument flies in 2019. It didn't fare too well back in 1973 and 1974, but the Judge Siricas have been systematically weeded out from the federal bench to be replaced by the likes of Clarence Thomas, Samuel Alito, and Brett "I like beer" Kavanaugh.

Each level should feel free to quickly say that as to move this case along.

(129,062 posts)it's the plaintiffs or defendants that would attempt to argue to a higher court that some error was made in the lower court and they want the higher court to hear the case. The higher court can reject it (outright or remand back with instructions) or agree to hear further.

(129,062 posts)If the subject matter is outside of the court's jurisdiction or decides the plaintiff or defendant doesn't have standing to bring the case, then they can just reject it.
