DEVELOPING Trump Justice Dept. asks U.S. judge to reject House Judiciary Committee request for Mueller grand jury materials, argues courts in 1974 wrongly gave Congress the Watergate grand jury 'roadmap' that led to President Nixon's impeachment.

she was appointed by Obama, and had been assigned to handle the Mueller Grand Jury cases/litigation.

(am guessing she has been facepalming for 2 years )

Republicans have been stacking the courts for decades to overturn decisions they don't like. We'll see how "the President is above the law" argument flies in 2019. It didn't fare too well back in 1973 and 1974, but the Judge Siricas have been systematically weeded out from the federal bench to be replaced by the likes of Clarence Thomas, Samuel Alito, and Brett "I like beer" Kavanaugh.

after a HUGE push (some of it broken when the filibuster was removed) since it had been left fallow for so long but was a critical court to have judges.

as no lower court has the authority to overrule a SC decision.

Each level should feel free to quickly say that as to move this case along.

it's the plaintiffs or defendants that would attempt to argue to a higher court that some error was made in the lower court and they want the higher court to hear the case. The higher court can reject it (outright or remand back with instructions) or agree to hear further.

If the subject matter is outside of the court's jurisdiction or decides the plaintiff or defendant doesn't have standing to bring the case, then they can just reject it.

That and the D.C. circuit court (which is 7 (D) - 4 (R)) were the #1 courts (behind trying to get his final SCOTUS appointee) that Obama targeted to get filled.
