Nancy Pelosi Just Made a Major Impeachment Power Play

She won’t send the articles of impeachment to the Senate until she feels they’ll get a fair hearing.

WASHINGTON — Minutes after the House voted to impeach President Trump, House Speaker Nancy Pelosi (D-Calif.) dropped a bombshell: She won’t send the articles of impeachment to the Senate until she feels they’ll get a fair hearing on the other side of Capitol Hill.

“We have legislation approved by the Rules Committee that will enable us to decide how we will send over the articles of impeachment,” Pelosi announced in a Wednesday night press conference. “We cannot name [impeachment] managers until we see what the process is on the Senate side.”

The move could delay a Senate trial — and is a move by House Democratic leaders to try to leverage their power to force Senate Majority Leader Mitch McConnell (R-Ky.) to make concessions on how the trial will be run.

McConnell has been explicit that his only goal is to help Trump and the GOP, declaring on Tuesday that he’s “not an impartial juror” shortly after saying he was coordinating directly with the White House on impeachment strategy.

so even though McConnell is fine with any delay, Trump will demand action. Thus, Nancy will have significant leverage.

...will make it impossible for him to get the clean "exoneration" he deserves, sooner or later.

Even if Senate Repugs are still determined to play the "hear no evil, see no evil" routine, it's going to be a lot harder if they accede to Pelosi's demands, because that means a real trial, with real testimony and documentary evidence, and every bit of such information presented on the Senate floor is going to make vulnerable Republicans even more vulnerable should they acquit. It certainly won't look like "TOTAL EXONERATION!!!" when people have just spent a month witnessing testimony in the Senate trial pointing to clear-cut guilt, with the president's defenders being unable to present even a shred of evidence in support of his innocence.

...he has to recuse himself from voting in the case. Little Lindsey, too, because he made the same statement.

I'm pretty sure that, if they both take the oath proclaiming their impartiality after publicly denying it, they can be prosecuted for perjury under a future Democratic DoJ.

insist on about a fair trial, that McConnell has to recuse himself due to his publicly stated bias.

I was initially opposed to holding up the articles as a power leverage, but I trust that Nancy knows what she is doing.

The same rules that got a unanimous vote in 1999. I’m sure the Repubs will have no issues appointing an impeachment manager, and have him arguing against an empty chair.

and needless to say, that was an absolutely brilliant move by the Speaker.

It should be interesting to see what Sen. Shumer has to say today. As a result of Speaker Pelosi's move, McConnell has been put in a corner,

On the one hand, if McConnell continues to say that he will decide (and he's pretty much indicated where he'll go) and that there will effectively be "no trial", the Articles will never see the Senate floor. However, if there is an equitable agreement, then the evidence will be fully presented for all to see.

I don't see how either scenario makes McConnell look good.

Trump has blocked a number U.S. government employees such as Mulvaney and Bolton from testifying before Congress. The administration has almost reached the end of it's appeals process to block the testimony. Trump effectively neutralized the Mueller investigation by refusing to cooperate, but I feel the Judiciary is about to re-assert it's independence from the Executive. The fight to keep these people from testifying is the core of the Obstruction of Congress impeachment article. If Congress cannot compel the Executive to appear and to testify then Congress has no authority whatsoever.
