The senate makes it's own rules, and it has sole responsibility for trial and removal.

If 51 senators vote to do something, it gets done. Roberts only presides. He doesn't control. The senate can over turn anything he rules on with 51 votes.

If you mean scotus, they won't touch it. The house,, having impeached the potus has fulfilled its constitutional duty.

Presenting managers and articles is merely a parliamentary courtesy. It isn't required.

But unless they repealed the impeachment vote, the articles would stand until amended.

The senate would likely ignore the new hearings and proceed.

The dems could still amend the articles, or issue a new one, and vote again, creating a new charge the senate would have to do something with.

The senate could then just vote to dismiss it out of hand though.

This is a high stakes poker game. It's a game of what-if and what will people think.
