My advice to her would be hold the Articles until there is a vote on Witnesses.

Moscow Mitch says there won't be a vote on Witnesses until after the trial has already started she should tell him not good enough you let us know when you have taken a vote on the witnesses. Once you do we will go ahead and send the articles.

If nothing else she just never sends them over. If Mitch is just going to squash them immediately anyway it's no big deal.
