Here's a great question to ask:

If a man walks into a bank with a gun and says "This is not a bank robbery, but if you don't give me all of the bank's money, I will shoot you!", then the man with the gun scoops up the bank's money and leaves....is it still a bank robbery in spite of the man's saying that it is not?

If the man with the gun walks 20 feet from the guard and never makes contact with him--never fires the gun either--and the guard suffers a fatal heart attack, the man is charged with murder.

The thinking there is most likely the guard wouldn't have died if the man had just stayed home. And the robbery was pre-meditated.

What you've described is a (passive) form of bank robbery. You have a suspect, a gun, and money being removed from the bank. It's the end result that counts, not the process.

If so, Giuliani will defend him, and Alan Dershowitz will explain that the Founders never intended for this to be a crime. That man is simply exercising his right as a white male to carry his gun everywhere.
