John Flannery: Another way to secure witnesses in the Senate trial and requires no vote

Another way to get witnesses, based on a reading of the Senate rules, is an application made directly to the Presiding Officer, Chief Justice Roberts, seeking a subpoena to issue for John Bolton.

This draft application (attached) for a subpoena for Mr. Bolton argues that the Presiding Officer has the authority on his own to issue a subpoena without reference to any vote by the Senate in the pending impeachment trial.

Action by the Chief Justice on this subpoena question would very likely take the “politics” out of the issue.

There has even been a proposal by one of the Senators to do just that and have the Chief Justice decide the question of witnesses.

Fence sitting Senators should prefer a procedure such as this because it relieves them from voting on the subpoena issue. It also favorably comports with the precise oath that each Senator swore, as this process is entirely impartial.

If he does and drumpf claims "Executive Privilege" Roberts will go along because he is part of the right wing Russian Repugs Revolution. he just lies about it but always votes that way.

Even on the ACA, he ok'ed gutting it, just said what was left was constitutional, knowing drumpf would blow it up. ON every single consequential ruling in his life, he's voted right wing. Right now he's stopped all the lawsuits against drumpf for not producing documents, put a stay on it and is refusing to expedite the ruling. He's also refused to expedite the ACA ruling and it won't come until after the election. He's a right wing Russian Repug and we are in dire shape if we have to depend on him developing a conscience for the first time in his life.

If he isn't then he will do the right thing and bring in a witness or two but if he is a Trump supporter he won't.
