BREAKING: Ohio Secretary Of State Backs Down, Allows Local Officials To Set Early Voting Hours

Husted also issued a formal apology to the court for Directive 2012-40. “The Secretary’s intention was not to create a stay of this Court’s Order,” the filing read. “The Secretary apologizes to the federal district court for creating that misimpression and has rescinded Directive 2012-40.”

but realistically, since the federal judge told Husted that he wanted Husted's very own ass in court to explain in person why the Secretary of State was refusing to obey a federal court order, what other action could Husted have taken? It's not like Husted was willing to go to jail or anything. I bet that Husted will try to find some other way to deep-six early voting and will have to be called on the carpet again. What a moran!

First, as I've pointed out in previous posts, there never, ever was going to be a contempt citation, jail or a fine for Husted. The court ordered him to appear in large part so he could answer questions as to what the facts are surrounding the establishment of hours for voting pursuant to the court's order and communicating that information to the public. The court's original order didn't set a date for compliance so essentially the hearing was going to be about setting that date.

Second, it doesn't appear that the author of the ThinkProgress piece actually read Husted's pleading all the way through. It rescinds the directive telling the local boards not to set voting hours for the 3-days preceding election day, but then does what I predicted Husted would effectively do at the hearing -- asks the court to grant a stay of its order pending the appeals court's ruling. I doubt the court will grant the stay, but it is not out of the question that the court will conclude that there should be one state-wide set of hours, not different sets of voting hours in different counties and will give Husted some time -- a week? -- to formulate a uniform approach and commumnicate it to the local election boards.

In short, not much has really changed.

The judge's ruling is in effect, the SOS directive has been rescinded, and the boards of election are to comply with the ruling restoring the early voting hours. That is the law at this time. Sure it could change in the future but that is always the case.

The move led Judge Peter Economus to set a hearing for September 13:
“The Court ORDERS that Defendant Secretary of State Jon Husted personally
attend the hearing,” his release read. IOTW Stop this bullshit or show up
in my courtroom in less than 1 week where I will rip you a new asshole.
