Stone's attorney Robert Buschell tells Jackson that the request for new trial goes to the heart of the case, but she wants to know why they did not request a delay when they filed the motion.

BREAKING: Judge Jackson plans to sentence Roger Stone as planned Thursday.
I think that delaying this sentence would not be a prudent thing to do under all the circumstances."

Todays phone conference in the Stone case was short/uneventful. The judge didnt take up the flip-flopping sentence recommendations by the prosecution. Instead, it was more about the pending (frivolous, IMO) new trial motion. Sentencing still set for Thursday. More to follow ...

Some intersting Roger Stone stuff. The defense filed yet another motion for a new trial claiming a juror was biased & shouldnt have been allowed to serve on the jury. Despite what Dershowitz & Judge Napolitano say, I predict Judge Jackson will deny the motion. Of course, Trump
has already impertinently/inappropriately tweeted that the New Trial Motion should be granted. Of course even the newly assigned prosecutors are opposing the New Trial Motion. Lets see if Barr makes them change THAT the way he made them change the sentencing ask (more to come).

Judge Amy Berman Jackson, during a conference with Roger Stone's defense team and the Justice Department, ultimately wanted to check in with attorneys to see whether they were prepared to move forward with Thursdays sentencing for Stone.
"I dont intend to discuss the merits of the motion or the sentencing at this time," Jackson says, starting off.
John Crabb says the DOJ is OK with going forward with sentencing Thursday. Stones attorney asked Jackson to decide on motion Stones team filed last week, requesting a new trial, before sentencing.

My guess is it'll be like a year.

(86,748 posts)by former DoJ personnel that she should take him into custody at sentencing and have him incarcerated right then and there after she tells him he gets the max. There will be a major stink bomb lobbed if the imbecile tries to pardon him.

(14,321 posts)pending a ruling on the request for a new trial. In other words, if she gives him X number of years, she will suspend any incarceration until she decides whether the request for a new trial can proceed.
The good news is the request for a new trial appears frivolous.

(3,131 posts)Would that be grounds for a new trial?
If she only blogged about trump I wouldnt think that would do it unless she lied when questioned to be on the jury.
I think a new trial would likely end up in acquittal because I dont trust the DOJ to honestly reprosecute

(82,849 posts)Then why did Stone allow the juror to be seated in the first place? "Because we just thought of it" isn't a very persuasive argument from what I've seen.

(24,426 posts)As I understand it, though, the vote to convict on all charges wasn't even close. But the whole thing is frivolous anyway. Everybody has political beliefs and if we start dissecting in fine details everybody's political beliefs, then virtually nobody would be allowed to serve as jurors if they have the slightest whiff of political beliefs that may run counter to the defendant's political views.

(10,952 posts)of a Presidential pardon is deemed an admission of guilt.
Then it should be:
Trump needed Russian help to get to the WH and Republican help to stay there.
Stone needed a Presidential pardon to avoid prison.
They can think whatever they want to think but Trump remains impeached for life and Stone will be deemed guilty for the rest of his life.

(10,749 posts)What conclusions might the public draw if the sentence given is lower than the initial sentence recommendation?
And what happens (heads up - nothing) when the dictator in chief pardons this piece of slime?

(5,810 posts)If tRumP gets to negate the jurys decision and the judges sentence why have we wasted money and time with a trial. It makes no sense to me. Are there no rules about the pardon? Like the circumstances of the crime or other factors that make a pardon fair. Maybe the person suffers from a terminal illness (that can be independently verified.) Or they have an advanced dementia, also proven by unbiased physicians. But just because tRump is your bud and wants you to keep silent about some things?? I dont think so. We definitely need to rethink the power to pardon by the President. tRump ruins everything he touches. He is rotten to the core.
Ligyron
(7,639 posts)I'm going with 7 years, the low end of original recommendation as that will look like she was being fair and what's 2 years if he gets pardoned anyway.
Can the state file charges if he does? I have no idea how that works.

(11,885 posts)He'll soon use, again trying to intimidate and scare her with. Stone is no better and deserves the maximum sentence. Trump and Barr are now openly trying to fix the sentencing for him calling his 7 felonies all an injustice jurors determined he was guilty of. trump is now promoting trump justice going after all who oppose him, while backers get off with little or no consequences. More people close to trump will be getting indicted, and face consequences for many crimes, including him.
