Supreme Court won’t intervene in Louisiana prisoner’s coronavirus complaint

The Supreme Court refused to intervene in a Louisiana inmate’s complaint about the coronavirus threat in his prison, continuing the high court’s cautious approach to the issue.

A district judge had agreed with Christopher Marlowe, who is a diabetic, that officials at the B.B. Rayburn Correctional Facility were not doing enough to protect inmates against the virus. But a panel of the U.S. Court of Appeals disagreed, and put that ruling on hold.

The Supreme Court in a short, unsigned order on Friday declined to reinstate the district judge’s decision. But it added:

“Nothing in this order should be construed to preclude applicant from filing a grievance setting out specifically the relief he requests be provided to him in the prison, and in the event that such request is filed, it should be decided promptly.”

There were no noted dissents.
