(1,923 posts)Those arrested will be tried in normal courts with the all rights as usual. Under martial law, there are no operating civilian courts, everything is done through military tribunal.

(1,923 posts)But I see martial law as a state where all rights and the Constitution are suspended, civilian courts are suspended, and the military is giving orders to civilian leaders and police. Invoking the Insurrection act allows active duty military to perform the some actions that the National Guard units already have been doing.
