Virginia judge blocks governor's demand to pull down Confederate statue

(Reuters) - A judge in Richmond, Virginia, on Monday issued a 10-day injunction against Governor Ralph Northam's decision to remove a statue of Confederate General Robert E. Lee from the city, according to the Washington Post.

Northam said last week that the statue should be taken down from its pedestal "as soon as possible", amid nationwide protests demanding racial equality following the death of George Floyd, a black man, in Minneapolis police custody on May 25.

The injunction was issued by a Richmond City Circuit Court judge on Monday, the Post reported. A lawyer for the man who sought the injunction - William C. Gregory - did not immediately respond to a request for comment, nor did Northam's office.

Calling for the Department of General Services to remove the towering statue of Lee, Governor Northam acknowledged the move could stir anger among admirers of the commander of the Confederate Army of Northern Virginia.

The deed signed in 1890 giving Virginia control of the Robert E. Lee statue on Richmond’s Monument Avenue prevents its removal, a lawsuit filed Monday that led to a pause on the state’s plans for taking it down claims.

In an 18-page complaint filed Monday, William C. Gregory, the great-grandson of two signatories of the deed, argues that under the terms of the 1890 agreement and a legislature-approved resolution, the state is supposed to consider the monument and the area around it "perpetually sacred" and "faithfully guard it and affectionately protect it."

Any judge impressed by this would be likely to rule some 'covenant' in a deed requiring the house never be sold to a Negro was enforceable today.

so in case the leave it up side prevails, seems too much to take it down right away - wait for the case in chief to play out. It could be removed anyway. This article just tries to inflame people by not even asking what the cause is for the injunction to leave it.
