Did Ali Velshi make a legal slip up?

For all the DU-lawyers out there: Velshi just said that discrimination against LGBTQ is outlawed in workplaces everywhere now. But if this was decided under Title VII or the CRA, that applies only for employers with 15+ employees. A.small employer could still discriminate, right?
