maybe because he saw the shitstorm that resulted and figured he didn't want to be hit with yet another obstruction of justice charge after he's 86'd out of the White House (a ship that has already sailed anyhow). But Barr probably can't fire him because he was re-appointed as the interim US attorney by a judge of SDNY pursuant to statute. So Barr's under the bus and Berman's status (brilliantly described in another thread by DUer Cirque du So-What as Schrödinger's US Attorney) remains to be determined. Trump will probably have to fire him but he won't (because he's afraid to?). Barr tries to fire him but legally he can't - but probably hoped Berman would go quietly and take the civil division job he dangled. But Berman isn't having it.
