They seem pleased to be caught on tape acting like assholes.

(32,017 posts)Deterrence of future, similar acts requires some kind of criminal sanction. Still, its his call. Besides, the DA might not need his cooperation. The video is quite public and quite damning in itself.

(32,017 posts)I suppose I feel bad for the New York DA who stuck his or her neck out to prosecute this case, but perhaps the prosecution can go forward without Mr. Coopers cooperation.

The way criminal law works is that the state is the victim; the actual victim is merely a witness. The state often (but not always) defers to the actual victim, depending on the strength of the evidence without its key witness and on the need to enforce the law as a deterrent to others.

(8,678 posts)Maybe a minor sentence of community service or something similar. Throwing her in jail seems overkill. She has certainly already paid a steep price for her stupid racist stunt.
