NEW: The judge in Michael Flynn's case has asked the full DC Circuit to reconsider the 2-1 panel decision that would force him to grant DOJ's motion to dismiss the prosecution.

His points on Mandamus are key. Flynn could still petition the court but his chances are dimished

This court has 11 members and only 4 are appointed by rethugs. 2 of those 4 ruled for Flynn.
