A federal court has dealt a setback to the Trump administrations attempts to restrict health care for LGBTQ+ Americans, ruling that the administrations attempted rule change will cause patients to fear discrimination at the hands of religiously affiliated providers.
At issue is a component of the Affordable Care Act known as Section 1557. Passed as part of Obamacare, the rule prevents healthcare providers from discriminating against patients on the basis of sex stereotypes. Republicans had sought to overturn the rule so that religious providers could refuse to treat queer patients.
But on September 2, Judge James E. Boasberg granted an injunction preventing the rule from being overturned for now. A final decision in the case has yet to be issued.
Much of the ruling centers around technical issues of standing, but the injunction indicates that the court believes patient advocacy groups are likely to succeed in their litigation, and that they are likely to suffer irreparable harm.
