Why I hate Property Insurance companies ...



Well, ALL insurance companies.

Thank you for your prompt reply. However, we are looking at nine (9) days from now. Our kitchen has been largely unusable for going on two weeks. I think you will agree waiting another nine days is unacceptable. Is there someone else available on the near term?

Good Afternoon Brian,

A Senior Property Loss Specialist (Lori Rae Barrios) just left my house after inspecting the damage to our home. She said, and provided a letter indicating, that our claim would be/is denied because the policy excludes damage from leakage/seepage that has occurred over time, even though we would have no way of knowing that the leakage was occurring because the leaking pipe was behind a cabinent.

The Denial Notice Ms. Barrios provided cites to the policy sections that support the denial ... Section I - Perils Insured Against, Coverage A - Dwelling and Coverage B - other structures (2)(e); specifically, numbers 1 and 9, and Section I - Exclusions, (1)(i)). While I see the first section (Section I - Perils Insured Against, Coverage A - Dwelling and Coverage B - other structures (2)(e)(1) "Wear and tear, marring, deterioration&quot , it begs the question, how exactly do enclosed pipes come to leak - if not through these apparent disqualifiers?

But more disturbing, none of the other exclusionary language in the Denial Notice is contained in my policy. Specifically, the Denial Notice includes a ninth (9th) policy term discussing "seepage", my policy contains no ninth term in the Perils Insured Against section. Likewise, the Denial Notice cites to a section (i) in the Exclusions section, my policy contains no term (i).


Where do I go from here?

I think it need not be said, I am more than disappointed with how this matter is being handled.

I guess I asked for the wrong thing. When I said I needed my policy declaration, I meant the homeowner's insurance policy document that spells out the terms of the policy ... specifically, what is, and is not covered and under what conditions. Thanks.

And to compound matter, the Property Loss Specialist attempted to insult me by first, having ME work around her schedule ("I don't work weekends" ... Well neither do I, that's why I want you to come out during the weekend)), then she ended our discussion with "Believe me ... I'd rather write a check, than issue a denial."

Really ... Do I look stupid to you?

They will take about 30% of what you get, but you'll get more than if you make the claim yourself.

Now if I have any homeowners insurance claims I call a public adjuster before I call the insurance company.

It seems that every year or two I am faced with a quixotic mission ... my insurance carrier seems to have provided me one for the year.

Fortunately, with this one, I don't think I'll need a public adjuster because the exclusion langauge that they are relying on does not exist in my policy (contract) and the one (or two) part(s) that might apply (the "wear and tire, marring, deterioration" part) would lead to a absurd results. In essence, to deny the claim they would have to argue we we cover the damage caused by pipes, only if someone acts upon the pipe because all other pipe failures can be defined by these terms. If that's the case, why cover water damage from pipes ... I would have a forum for the damage they would cover in criminal or civil court; why would I need, and pay for, the coverage?

Not looking ahead (but doing so because I'm pi$$ed) ... If I am forced to sue, the first item of discovery will be A) the number, and B) estimated value of similarly denied claims, going back 10 yeards; and my settlement offer will be A x B + Aggravation ... that'll be in the millions.
